De Grondwet bepaalt dat de verkiezingen geschieden volgens het
stelsel van de evenredige vertegenwoordiging. Dit houdt in dat de zetels naar
evenredigheid van de stemcijfers worden toegekend. Het huidige systeem
(Imperiali) om bij gemeenteraadsverkiezingen stemcijfers naar zetelaantallen om
te zetten, dateert van 1921, maar is bij nader inzien zeer sterk geïnspireerd
door de oudere kieswet van 1895.
In dit standpunt worden de systemen Imperiali, d'Hondt, en Niemeyer met elkaar vergeleken. Imperiali heeft de zwakste performantie. Vooreerst is Imperiali geen proportionele regel. Aansluitend onderzoeken we de kloof die deze systemen genereren tussen de Banzhaf-index en coalitie-vorming (representatieve democratie) op basis van stemcijfer en op basis van zetelaantallen. Ook volgens dit criterium bengelt Imperiali onderaan. De bevindingen worden geïllustreerd aan de hand van de gemeenteraadsverkiezingen van 8 oktober 2000. Tenslotte argumenteren we dat bij het bepalen van een kiesdrempel zowel het aantal partijen als het aantal zetels in rekening gebracht moet worden. Bijgevolg zal de kiesdrempel---uitgedrukt in kiezerspercentage---verschillende waarden aannemen over de verschillende gemeenten. Het systeem Imperiali is begrijpbaar vanuit het historische kader voor en vlak na de eerste wereldoorlog, maar kan in de huidige context nog moeilijk verdedigd worden. Zelfs indien men, net als toen, vindt dat bij lokale verkiezingen een minimale vertegenwoordigingsdrempel nodig is, kan men niet voorbijgaan aan de bijkomende bevoordeling van grotere partijen. |
